The US Court of Appeals for the Third Circuit upheld Thomson Reuters' win against Ross Intelligence, which copied Westlaw headnotes, short summaries of court rulings, to train a competing AI legal research tool. The earlier judge found the use was not transformative. It is the first US appeals ruling on copyright and AI training, though it concerns a search tool, not generative AI.
- If you build an AI tool on someone else's content, get a licence in writing, especially if your product competes with theirs.
- Check the terms of any AI vendor you use for copyright indemnity, and whether it covers small customers.
